Terms of Service

Here's the gist in plain English. This summary is not a substitute for the full terms below, which control.

  • Promise is a technology platform — not a doctor's office or a pharmacy. Care comes from independent licensed providers in the WizDoc, LLC network; medications are dispensed by PerfectRx.
  • A provider decides whether to treat you and can say no. We don't guarantee you'll qualify for, or receive, any product or result.
  • Compounded medications are not FDA-approved. Make sure you understand the risks before starting treatment.
  • Disputes are resolved by individual arbitration, and you waive class actions — but you can opt out within 30 days. Certain sexual-misconduct claims are excluded.
  • These terms are governed by Arizona law, and our liability to you is limited.

1. Acceptance of these terms

These Terms of Service ("Terms") are a binding agreement between you and myPromise, LLC ("Promise," "we," "us"). By accessing or using mypromise.com (the "Site") or our services, you agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Site.

2. Who can use Promise

You must be at least 18 years old, able to form a binding contract, and physically located in a U.S. state or Washington, D.C. that we serve at the time of your visit. Products and services are for personal use only and are not available everywhere; availability depends on your location and applicable law.

3. What Promise is (and isn't)

Promise is a technology platform that helps connect you with independent, licensed clinicians in the WizDoc, LLC network and with our partner pharmacy, PerfectRx. Promise itself is not a healthcare provider, medical group, or pharmacy; it does not practice medicine, provide medical services, or dispense medications. The providers and the pharmacy are independent of Promise and are solely responsible for the clinical and dispensing services they provide.

4. Not medical advice

Content on the Site is for general informational purposes only and is not medical advice, diagnosis, or treatment. It is not a substitute for professional medical care. Always seek the advice of a qualified health provider with any questions about a medical condition, and never disregard professional advice because of something you read on the Site.

5. Emergencies

Promise is not for medical emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. Do not use the Site to request emergency care.

6. Your relationship with the providers

Using the Site does not create a provider-patient relationship between you and Promise. Any clinical relationship is solely between you and the treating provider in the WizDoc network.

Each provider exercises independent professional judgment. A provider may determine that a product or treatment is not appropriate for you and may decline to treat you or to issue or renew a prescription. We do not guarantee that you will qualify for, be prescribed, or receive any particular product, treatment, or outcome. Promise does not control, and is not responsible for, the clinical decisions the providers make.

7. Telehealth consent

Telehealth is the delivery of health care using secure electronic communications instead of an in-person visit. It has benefits (such as convenience and access) and limitations (for example, a provider cannot physically examine you, and technology can fail). In some cases a provider may determine that telehealth is not appropriate and that you should be seen in person.

By using our services to seek care, you consent to receiving care through telehealth. Before treatment, you will complete a separate informed-consent process directly with your provider as required by the laws of your state; that consent, together with your provider's own policies, governs the clinical relationship. You may withdraw your consent to telehealth at any time by notifying your provider, without affecting care already provided.

8. Your account & accurate information

You agree to provide truthful, accurate, current, and complete information, including medical information, and to keep it up to date. Providing inaccurate or incomplete information can lead to inappropriate treatment and serious harm. You are responsible for maintaining the confidentiality of your account credentials and for activity under your account.

9. Prescriptions, compounded medications & fulfillment

Only a licensed provider can issue a prescription, and only when they determine it is clinically appropriate. Prescriptions are filled and shipped by PerfectRx.

Compounded medications are not approved by the U.S. Food and Drug Administration. The FDA does not review compounded drugs for safety, effectiveness, or quality before they are marketed, and compounded products are not generic or "bioidentical" equivalents of any brand-name drug. Your provider can help you understand the risks and benefits.

Unless required by law, prescription medications cannot be returned once they have been dispensed and shipped. Title and risk of loss for shipped products pass to you when the pharmacy provides them to the carrier. Shipping times are estimates and are not guaranteed.

10. Pricing, billing & subscriptions

Prices shown on the Site are illustrative and may change; the price and billing terms that apply to you are those presented to you when you place an order. Payments are processed by the WizDoc, LLC (Wizlo) platform — not by myPromise — and are subject to its billing terms.

Subscriptions are optional. If you choose a recurring plan, it automatically renews until you cancel, and the billing amount, frequency, and renewal terms are disclosed before you are charged. You may cancel at any time, using a method at least as easy as the one you used to sign up.

Refunds. If you are not approved during the intake — for example, if a provider determines you are not eligible — you will be refunded. You may also request a refund, which is handled through the WizDoc (Wizlo) platform that processed your payment. Because dispensed prescription medications generally cannot be returned, amounts charged for medications that have already shipped may not be refundable except where required by law or approved on request.

11. Acceptable use

You agree not to: misuse the Site; access it using bots, scrapers, or other automated means; attempt to gain unauthorized access to any system; create accounts using false information or on behalf of someone else without authorization; or use the Site to violate any law or the rights of others.

12. Intellectual property

The Site and its content — including the "Promise" name and logo, text, graphics, and design — are owned by myPromise, LLC or our licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, revocable license to use the Site for its intended purpose. You may not copy, modify, distribute, or create derivative works from our content without our permission.

13. Third-party links & services

The Site may link to or rely on third-party services — including the provider platform, the pharmacy, and payment processors — that have their own terms and privacy policies. We are not responsible for third-party services or content, and your use of them is at your own risk.

14. Disclaimers

The Site and services are provided "as is" and "as available," without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, error-free, or that it will produce any particular result. Promise makes no warranty regarding any product or the clinical services provided by the independent providers or pharmacy.

15. Assumption of risk

You understand and accept that all medical treatment carries risk, and that compounded and off-label therapies carry particular risks — including that they are not FDA-approved, that outcomes vary between individuals, and that dosing and response can differ. You agree to discuss these risks with your provider and to make an informed decision before beginning any treatment.

16. Limitation of liability

To the fullest extent permitted by law, Promise and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from or related to your use of the Site or services. Our total liability for any claim will not exceed the greater of $100 or the total amounts you paid to Promise in the 12 months before the event giving rise to the claim.

These limits do not apply to liability that cannot be limited under applicable law, including liability for our fraud, gross negligence, willful misconduct, or violations of confidentiality or health-privacy law. Some states do not allow certain limitations, so parts of this section may not apply to you.

17. Indemnification

You agree to indemnify and hold harmless Promise (and its owners, employees, and agents) from claims, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site, your violation of these Terms or any law, or information you provide that is false or misleading.

18. Dispute resolution & arbitration

Please read this section carefully — it affects how disputes are resolved and limits your rights.

Informal resolution first. Before starting arbitration, you agree to contact us at legal@mypromise.com and give us 60 days to try to resolve the dispute informally.

Binding arbitration. If we can't resolve it, you and Promise agree that any dispute will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs this section.

Class-action & jury waiver. Disputes will be arbitrated only on an individual basis. You and Promise waive the right to a jury trial and the right to participate in a class action, class arbitration, or representative action.

Your right to opt out. You may opt out of this arbitration agreement by emailing legal@mypromise.com within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration. Opting out does not affect any other part of these Terms.

Exception. Consistent with the federal Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act, claims of sexual assault or sexual harassment are not subject to mandatory arbitration if you choose to bring them in court. Either party may also bring an individual claim in small-claims court.

19. Governing law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. To the extent any dispute is not subject to arbitration, it will be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to their jurisdiction.

20. Changes, termination & other terms

Changes. We may update these Terms from time to time. We will revise the "Last updated" date, and, for material changes, provide more prominent notice as required by law. Continuing to use the Site after changes take effect means you accept the updated Terms.

Termination. We may suspend or terminate your access to the Site at any time if you violate these Terms or to protect our services and users.

Other terms. If any provision of these Terms is found unenforceable, the rest remain in effect. These Terms (with the Privacy Policy) are the entire agreement between you and Promise regarding the Site. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.

21. California notice

Under California Civil Code §1789.3, California residents are entitled to this notice: this Site is provided by myPromise, LLC, 7135 E Camelback Rd, Suite 230, Scottsdale, AZ 85251.
